WIPO Deal Mediation of FRAND Disputes WIPO Mediation was successfully used to facilitate FRAND patent licensing negotiations in three separate disputes. Each of the cases concerned the licensing of large telecom patent portfolios between SEP holders and implementers in Europe and China. In each of the cases the parties had also been involved in court proceedings in multiple jurisdictions and the settlements resolved the court litigation between the parties globally. All three cases were administered by the WIPO AMC Singapore Office, with the support of the WIPO Arbitration and Mediation Shanghai Service in two cases that were partially administered in Chinese. These cases are recent examples of WIPO Mediation being used for “deal mediations”, namely mediation to facilitate entry into or renewal of commercial agreements. Exciting times lie ahead for World Intellectual Property Organization – WIPO and the WIPO Arbitration and Mediation Center as we strengthen our Alternative Dispute Resolution (ADR) collaborations for copyright and digital content disputes on the global stage.   Last Tuesday, I had the privilege of meeting key stakeholders shaping the landscape of copyright and content-related dispute resolution from the Republic of Korea. This in-person meeting marked a milestone following our longstanding collaboration between WIPO and the Ministry of Culture, Sports and Tourism (MCST) of the Republic of Korea, initiated in 2018.   During the meeting, the WIPO AMC team (Ignacio de Castro and Leandro Toscano) and I had fruitful discussions with Ms. Hyang-Mi Jung, Ms. Hyeyoon Choi, Ms. Hayoung Lee, from the Copyright Bureau of the MCST and Ms. Sooji Lee from WIPO. The meeting took place in Geneva during the Standing Committee on Copyright and Related Rights (SCCR) at WIPO, where discussions centered on the transformative impact of digital technology in the creative sector.   We were delighted to delve into key successes resulting from our collaboration through the WIPO-MCST Funds-in-Trust for ADR, and explore growth opportunities, particularly focusing on the MCST-WIPO development of online case administration tools to support the provision of ADR services by Copyright Offices. These tools have already benefited countries such as Colombia, Guatemala, Mexico, Paraguay and Trinidad and Tobago.
