It was a pleasure to participate in European Cyber Agora 2024 in Brussels. I joined the panel “Cyber Mercenaries: The Search for Policy Solutions” which reflected on the growth of the cyber mercenary and intrusion industry (aka cyber arms dealers) and the genuine challenge it represents for policymakers to control the use and deter the misuse of these tools. Whilst there are legitimate roles for these firms and the resources they possess in support of national security, there have been well-publicized examples of these services being used to target journalists, human rights defenders, dissidents, and private companies far from what would be seen as a legitimate use. There is a growing market for these services, enabled by an increasing number of vulnerabilities and a society not yet accustomed to taking preventive measures, such as installing additional security on their mobile phones. As defenders, ESET has observed an 80% surge in spyware detections. These potent tools should inherently carry significant responsibilities and accountability for both users and providers. Considering the potential risks and harm, this is certainly not an area to be left solely to self-regulation. I applaud the work of civil society in exposing the abuse and misuse of spyware. However, achieving a swift international consensus on this issue will not be easy. I support initiatives such as the Pall Mall process and urge policymakers to actively pursue its objectives in their efforts to limit the spread and irresponsible use of commercial cyber intrusion tools with vigour.
